Terms of service

§ 1 Scope and Contracting Party

(1) These General Terms and Conditions (hereinafter "GTC") apply to all orders placed by consumers or businesses through our online shop activated-store.com.

(2) The contracting party is:

(3) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

(4) An entrepreneur within the meaning of these GTC is any natural or legal person or partnership with legal capacity that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

§ 2 Subject Matter of the Contract

Our online shop offers the following product categories:

2.1 Physical Products

Clothing (merchandise), accessories, and gadgets from the ACTIVATED brand and our artists.

2.2 Digital Products

Sample packs, production kits, sound libraries, assets, and music files (songs) for download.

2.3 Services

a) Mixing: Professional mixing of your music production

b) Mastering: Professional final processing for release quality

c) Ghost Production: Creation of individual music productions according to your specifications

§ 3 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to submit an order (invitatio ad offerendum).

(2) By clicking the button "Place order with payment obligation" or a similar designation, you submit a binding order for the goods or services contained in the shopping cart.

(3) Confirmation of receipt of your order is sent immediately after submission by an automated email (order confirmation). This does not yet constitute acceptance of the contract.

(4) The contract is concluded:

  • • For physical products: Upon shipment of the goods and sending of a shipping confirmation
  • • For digital products: Upon sending of the download link by email
  • • For services: Upon confirmation of order acceptance by email

§ 4 Minimum Order Value

The minimum order value is EUR 20.00. Orders below this value cannot be completed. Services are exempt from this regulation.

§ 5 Prices and Payment Terms

(1) All prices shown are final prices and include statutory VAT. Additional delivery and shipping costs are shown separately and are to be borne by the customer.

(2) The following payment methods are available: PayPal, Klarna (invoice, installment purchase), credit card (Visa, Mastercard, American Express), and instant bank transfer (Klarna Sofort).

(3) Payment is due upon conclusion of the contract. For payment by Klarna invoice or installment purchase, Klarna's payment terms apply.

§ 6 Delivery of Physical Products

6.1 Delivery Area

We currently deliver to all countries of the European Union (EU). Deliveries outside the EU are currently not possible.

6.2 Shipping Provider

Shipping is carried out via DHL.

6.3 Delivery Times

The delivery time begins after receipt of the order confirmation and is:

  • • Germany: 4-5 business days
  • • Other EU countries: 8-10 business days

Saturdays, Sundays, and public holidays are not considered business days. Deviating delivery times are indicated on the respective product page.

§ 7 Digital Products

(1) After successful payment, you will receive an email with a download link for the purchased digital product.

(2) The download link is valid for a limited period and a limited number of downloads. The exact conditions are communicated in the email.

(3) With the purchase, you receive a simple, non-transferable right of use for private purposes or the purpose specified in the product description.

(4) Prohibited: Sharing, resale, making publicly available, or reproduction of the digital content unless expressly permitted.

§ 8 Services (Mixing, Mastering, Ghost Production)

8.1 Mixing and Mastering

Each package covers one track. The scope shown on the product page applies: Mastering Standard includes 1 revision and Pro 2 revisions; Mixing Standard covers up to 60 tracks with 2 revisions, while Mixing Pro covers up to 100 tracks, basic editing and 3 revisions. Mix + Master includes the scope and revision rounds of the selected Standard or Pro packages. Additional work is charged only by separate agreement.

Nils Puschmann handles the work. The customer supplies the audio files required for the selected package, a rough mix and any references. A download link can be provided with the order or emailed to n.puschmann@activated-network.com, quoting the order number. Stereo mastering requires the finished mix; mixing and stem mastering require the corresponding separate tracks.

Processing time starts after order acceptance, payment, receipt of all required files and the permitted start of work: Mastering Standard 2–5 business days, Mixing Standard 5–10 business days and Mixing Pro 7–14 business days. The schedule for Mastering Pro and Mix + Master is agreed after reviewing the material, before accepting the order. Without an express early-start request, work begins after the 14-day withdrawal period ends. Delivery is digital by download link, without shipping charges.

8.2 Ghost Production

(1) Ghost productions are individual music productions created according to your specifications. Standard packages and individual productions by arrangement are available.

(2) Immediate contact is required after purchase to discuss the details of the production (genre, style, reference tracks, special requests).

(3) Revisions: Up to 2 (two) revision rounds are included in the standard price. Further revisions can be ordered for an additional fee.

(4) Upon full payment and delivery, all usage and exploitation rights to the production are transferred to the customer, unless otherwise agreed.

§ 9 Right of Withdrawal

The right of withdrawal applies exclusively to consumers. A detailed cancellation policy with a model withdrawal form is provided separately.

9.1 Physical Products

You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you took possession of the goods.

9.2 Digital Products

The right of withdrawal expires for digital content not delivered on a physical medium if we have begun performance of the contract after you have expressly consented to our beginning performance before expiry of the withdrawal period and confirmed your knowledge that you lose your right of withdrawal by consenting.

Note: By clicking on the download link, you consent to the immediate commencement of contract performance and confirm that you lose your right of withdrawal.

9.3 Services - Mixing and Mastering

Consumers generally have a 14-day withdrawal period from conclusion of the contract for mixing and mastering. The right expires early upon full performance of the service only if, before work begins, you expressly consented to work starting before the withdrawal period ends and acknowledged that your right expires upon full performance. Placing an order, starting work or clicking a download link does not replace these declarations. Without an express early-start request, we wait until the withdrawal period has ended.

9.4 Services - Ghost Production

For ghost productions, the right of withdrawal is completely excluded after conclusion of the contract, as these are goods made to customer specifications that are clearly tailored to the personal needs of the customer. By placing the order, you expressly agree to this exclusion.

§ 10 Warranty

(1) Statutory warranty rights apply.

(2) For physical products, the warranty period for consumers is 2 years from delivery. For entrepreneurs, the warranty period is 1 year.

(3) For digital products, we warrant that they are free from defects that impair their functionality at the time of provision.

(4) For services, we owe professional execution according to the state of the art. Artistic or creative results are subject to subjective evaluation; a defect only exists if the service objectively deviates from the agreement.

§ 11 Limitation of Liability

(1) We are liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence.

(2) For slight negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal obligations), the fulfillment of which enables the proper execution of the contract in the first place. In these cases, liability is limited to the foreseeable, contract-typical damage.

§ 13 Online Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR):

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with habitual residence in the EU, mandatory provisions of the law of the country of residence remain unaffected.

(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes is Giengen an der Brenz, Germany.

(3) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
